Nevada Specific Divorce Forms   Nevada            Divorce Paper Preparation & Assistance Attorney Supervised Contact us Divorce Packages, Forms and Services Agreement for Services This Agreement is being entered into between the individuals desiring the document preparation services of Nevada Divorce Assistance (the client(s)) and Nevada Divorce Assistance (NDA). This Agreement does not go into effect until it is sent by the clients to NDA and then accepted by NDA. The client agrees to all of the following. The terms of this Agreement are for NDA to provide completed forms to client in order for client to obtain a divorce as well as instructions to client to obtain a divorce. The forms will conform to the information provided by clients to NDA, however NDA is not responsible for inaccurate information provided by client and NDA does not check the accuracy, truthfulness or completeness of any information provided by the client. While NDA prepares the papers based upon the information provided, neither it nor any attorney working for NDA represents the client in any legal proceeding and should the clients ever disagree as the terms of their divorce, then they should not sign the documents and should contact an attorney. If the papers have been filed with the court, then they should be immediately withdrawn. In either of these events, NDA earns its fee when the papers are drafted and will not refund any monies based on the clients having a change of heart and now disagreeing amongst themselves. NDA does not provide legal advice. Your case documents are reviewed only for format accuracy and completeness. No attorney will review your actual case. Any review or supervision by an attorney is only to make sure the forms are correctly prepared with the information the clients provided. NDA and its employees are not acting as your attorney and do not practice law or give legal advice. No attorney-client relationship is being formed by using this Web site service. As with any legal matter, it is always possible to input incorrect information which could affect the outcome of your case in court. The forms and information provided by NDA are not a substitute for the advice of an attorney. The forms provided may not deal with all issues that the clients may have or that may arise and clients should consult an attorney that can personally deal with their individualized needs. The clients agree that the fees are earned by NDA in the following manner. One-third of the fees are earned when the initial questionnaire is submitted to the client, one-third is earned when the initial questionnaire is returned and the final one-third is earned upon NDA drafting the initial papers. NDA is not responsible for your spouse changing their mind and not wanting to singe any forms and will not issue any refunds on this basis or any other basis beyond NDA’s control. While it is possible that changes may be needed to the forms, NDA has fully earned its fee when the initial papers are first drafted. If any changes are desired by the client based upon the client changing what terms are desired in the papers, there will be additional charges to the client which will vary depending on the amount of time involved in making the changes and the final papers will not be sent to the client until these additional charges are paid in full at the rate of $25 for every 15 minutes or portion thereof. The client acknowledges and agrees that all forms and questionnaires sent to clients by NDA are the copyrighted property of NDA and may not be reproduced or used in any form other than for the personal divorce filings of clients. NDA reserves the right to not provide services or forms if NDA believes that the clients are not following the required laws of Nevada, are committing fraud to obtain a Nevada divorce or if clients do not meet the requirements for a Nevada divorce. In this event, NDA will return the full fees paid by the client. The clients agree that if NDA files the divorce papers for the client, the client agrees to not contact NDA regarding the status of the divorce no sooner than three (3) weeks after the papers are received and no more than once a week. Calls in excess of this will be charged $10 per call. NDA promises to keep the client informed as to the status once NDA learns of any information, so no calls are actually necessary by the client. But if the clients file their own divorce, NDA services are terminated once the papers are delivered to the client and NDA will not keep track of the status of the divorce. The client agrees that NDA is not responsible for any damages of any sort including from any computer damages such as from a viruses any damages for the content in NDA’s forms including the clients not obtaining a divorce or their divorce being delayed due to the forms or any act or failure to act by NDA. If any forms are not accepted by the court, then the clients are to inform NDA within 14 days of learning of any problems and NDA will then remedy the forms and will fix any problems. If the problems cannot be resolved by NDA, then NDA will refund a prorate share of the fees paid to NDA for the forms that were insufficient. You must provide evidence to verify any rejection or denial of NDA’s forms. NDA is not responsible for your mistakes and cannot guarantee the results or outcome of your divorce case. NDA cannot guarantee the judge will rule in your favor on any matter. In no event shall NDA be responsible for any damages and NDA is only responsible for a prorata share of the fees paid for any insufficient forms. The clients agree and understand that they are responsible for having their divorce forms reviewed by an attorney to make sure they are sufficient for their particular needs and in no event shall NDA be responsible for damages in an amount in excess of the fees paid to NDA by clients. Using the forms provided by NDA are done at your own risk. In no event will any person or entity contributing to the production of NDA’s forms be liable for any direct, indirect, or consequential damages resulting from use of NDA’s forms and information. NDA cannot guarantee the results or outcome of your divorce case. Each judge is different and NDA cannot guarantee the judge will rule in your favor on any matter. NDA is not responsible for your mistakes or circumstances beyond our control. The client and NDA agree that any dispute between them regarding NDA’s services to clients, then clients and NDA agree to resolve all legal disputes before binding arbitration. The client and NDA agree that all such claims must be brought within six (6) months of the day any forms were not accepted by the Nevada court in which they were filed or from the date any damages occurred if the damages were not based on the forms prepared by NDA. Binding arbitration is to occur before the American Arbitration Association (AAA) in Reno, Nevada and AAA shall apply Nevada law in rendering its decision. AAA may be found on the internet at www.adr.org . The parties further agree that AAA commercial arbitration rules shall apply except that the clients and NDA are responsible for their own attorney’s fees and costs regardless of who prevails in the arbitration and that the cap of any award is limited to the amount of fees paid by the clients to NDA. No representations or warranty that NDA’s forms are fit for any particular purpose are being made or that the forms are best for the clients particular needs, yet clients desire to use the forms anyway and forego using any attorney. The clients further acknowledge and agree that they should seek the services of an attorney prior to using or filing any forms prepared by NDA. If any of these terms in this Agreement are declared unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement relating to the subject matter herein and shall not be modified except as provided herein or in writing, signed by both parties. By ordering services you are acknowledging that you have read and agree to the above Agreement. Prices DO NOT include any Filing Fees - which vary, but are approximately $270.
